I have deleted a post which made use of some original Doc Savage artwork done by Dave Cockrum. While I gathered the images from several sources, the actual owner of the originals was not well pleased to see them posted here all together. Though my intent was to return the element of story to what had been presented in other venues by various folks as simply art, I can see clearly now that I did so poorly and without proper care. So they are gone. I offer my apologies for my miscue.

Does the owner of the original art have the right to dictate who can (or can't) publish them?
ReplyDeleteThe legal answer is...no, unless the owner is the creator (in this case the estate of the late, great, Dave Cockrum), or the copyright owner of Doc Savage, Conde Nast. And since the artwork was done in the early '70s, when copyright law regarding unpublished art was radically different, Conde might not have a claim, either.
While the art owner may have physical possession of the actual artwork, he/she did not purchase the reproduction rights!
In addition, under Fair Use, "Section 107 contains a list of the various purposes for which the reproduction of a particular work may be considered fair, such as criticism, comment, news reporting, teaching, scholarship, and research." (http://www.copyright.gov/fls/fl102.html)
Your usage certainly falls under several of those categories.
The only thing you might, repeat might, have done wrong is not attributed whose collections these were from.
I appreciate the information. The owner was upset that I didn't credit the site, but I got the images from several locations, and I didn't immediately realize that one guy owned them all, though on reflection I should have.

ReplyDeleteBut, I think it is classy that you respect the wishes of the owner. I just wish I'd visited the blog before they were down!
My goal with the blog is to have fun. Whatever can be done to keep the peace here in the virtual world, is something we all should strive for.

I spent a lot of time and money to track down the original to the second week of the strip and the scans you posted were mine. Feel free to repost the art when you want.
I had had you r blog pointed out by a couple of people who asked me if I had any idea how you were, that’s all. Sorry I was in a bad mood.
If you are into Doc Savage, I’ve been helping out Doc cover artist Bob Larkin the past couple of years doing exclusive projects trying to help Bob raise so much needed cash.
Bob’s wife Fran is suffering from brain cancer and the resulting surgeries has left her less than 100%. As a result, Bob is her full time care giver and has had to cut back his work load to care for her.
I’ve been pulling together professionals for all over to sign books with all profits going to help the Larkin’s cover the long term costs of medications and co-pays that insurance doesn’t cover.

No apology necessary. I am very happy to have your permission to repost those great vintage strips. You're lucky to have them in your collection, and gracious to share them. They are beautiful.
ReplyDeleteI am very sad to hear about Bob Larkin and his wife's illness. Larkin is a favorite artist of mine for sure. My wife and I have been working through some tough times with her health together too, and it can be brutal. Give Bob my best wishes.
I'll be happy to promote the site as best I can here and elsewhere.
